Hereinafter referred to as The Seller,
and any person wishing to make a purchase via the Seller's website at www.georgetta.fr,
Hereinafter referred to as The Client or The Buyer.
ARTICLE 1 - PURPOSE
These General Terms and Conditions of Sale aim to define the contractual relationship between the Seller and the Client, and the conditions applicable to any purchase made through the Seller's merchant website www.georgetta.fr, called the Site.
The Client must be at least 18 years old and have the legal capacity or parental authorization to place an order on the Site.
The acquisition of a product through the Site implies the Client's full and unreserved acceptance of these General Terms and Conditions of Sale.
The Seller reserves the right to modify these General Terms and Conditions of Sale at any time. The Conditions applicable to the Client will be those in force on the date of their order on the Site.
ARTICLE 2 - SITE
The website www.georgetta.fr is an e-commerce site. It is accessible to all internet users 24/7, except for interruptions, scheduled or not, by the Seller for maintenance and/or security purposes or in cases of force majeure. The Seller shall not be held responsible for any damage, whatever its nature, resulting from the unavailability of the Site.
The site is exclusively reserved for retail sales to individuals. The Seller reserves the right to refuse to fulfill any order.
The Site sells a variety of handmade accessories, referred to as the Product(s), to Internet users browsing the Site, referred to as User(s). After an order is validated, the User becomes a buyer and will be referred to as the Buyer. The rights and obligations of the User necessarily apply to the Buyer.
The Buyer declares to have full legal capacity.
Any order of a Product offered on the Site implies consultation and acceptance of the General Terms and Conditions of Sale by checking the box provided for this purpose before placing any order.
As a reminder, in accordance with the provisions of articles 1316 to 1316-4 of the Civil Code, supplemented by Decree n° 2001-272 of March 30, 2001 for the application of article 1316-4 of the Civil Code relating to electronic signatures, The Seller specifies that the validation of the order form as specified in article 5 below constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature.
The purpose of the General Terms and Conditions of Sale is to define the rights and obligations between the Seller and the Buyer, arising from the online sale of the Product(s) offered on the Site.
ARTICLE 3 - PRODUCTS
All Products offered for sale on www.georgetta.com are creations of the Georgetta brand. They are handmade by the brand's creator, Jurgita MENU.
Products are available on the Site while stocks last. In the event of unavailability of one or more Product(s) after an order has been validated, the Seller undertakes to inform the Client as soon as possible to indicate when the Product(s) will be available again. If the Product(s) are no longer produced, the Seller will offer the Client another Product(s) of the same value or a full refund of the originally ordered Product(s).
Products are described and presented on the Site with the greatest possible accuracy. Nevertheless, the photos of the Products on the Site are not contractual. Color variations may occur due to the technical limitations of computer equipment color rendering.
The Seller retains ownership of the Product(s) sold until full payment of the price. As such, if the Buyer is subject to a receivership or liquidation, the Seller reserves the right to claim, within the framework of the collective procedure, the Product(s) sold and remaining unpaid.
ARTICLE 4 – PRODUCT PRICES
The prices of the Products sold are those in force on the day of the order. They are expressed in euros excluding taxes. VAT is not applicable to sales within the meaning of article 293 B of the CGI. Consequently, prices are not subject to VAT.
The Seller reserves the right to modify the prices of Products sold on the Site at any time and without prior notice. However, it undertakes to invoice the ordered Products at the prices indicated on the Site at the time of order registration, subject to Product availability.
Delivery costs are not included in the Product prices.
The price is payable in full and in a single installment upon validation of the order.
ARTICLE 5 - ORDER
The User can browse the Site freely, without being committed to an order.
To order the Product(s) the User wishes, they must click on the "Add to cart" button, indicating the desired quantity. Each new addition will appear in their cart.
Before validating their order, the User can: obtain a summary of the Product(s) they have selected and modify their order, by clicking on the "View cart" link.
To finalize the order of the Product(s), the User will click on the "Pay" button and follow the instructions until the end of the transaction. They must identify themselves by creating an account, accurately filling out a form with the necessary identification information: their first name, last name, email address, date of birth, billing address, and delivery address (if different from the billing address).
The Buyer is responsible for updating their personal information. In case of an error in the recipient's contact details, the Seller will not be held responsible for the impossibility of delivering the Product(s).
Following the validation of their order on the Site, the User accepts these General Terms and Conditions of Sale.
The User is then invited to pay for their order using the payment methods offered by the Site. The order confirmation will serve as a signature and acceptance of the transactions performed.
The User receives an order confirmation with a summary of the purchase data by email.
An email confirming shipment will be sent to the Buyer on the day of Product(s) dispatch.
ARTICLE 6 - PAYMENT
Purchases are paid for by Paypal or credit card. Payment can be made securely on the Site from France or abroad, 24/7.
The Buyer must pay the full amount due for their order at the time of purchase, otherwise the order will not be taken into account. If payment is refused, the order will be cancelled.
The Seller reserves the right to refuse any order from a User with whom it is in dispute, of whatever nature.
The Seller also reserves the right to cancel any order that presents a risk of fraudulent credit card use.
If the Buyer makes a payment in several installments with Alma:
Payment in several installments/deferred payment is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
Purchase amount:
- 3X: Only purchases between €50 and €2,000 are eligible for payment with Alma.
Fees for the Buyer:
When paying in several installments with Alma, the Client does not pay any fees.
Alma is a remote payment manager and issues an electronic certificate that will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the Civil Code.
ARTICLE 7 - DELIVERY
Delivery times:
Order(s) are delivered, except in cases of force majeure, within the timeframe indicated on the order validation page, unless a specific manufacturing time is mentioned in the product description sheet. In the latter case, the mentioned timeframe should be taken into account.
The Seller undertakes to make its best efforts to deliver the Product(s) ordered by the Buyer within the deadlines specified above. However, the indicated delivery times are given as an indication from the day following the validation of the order by the Buyer. They correspond to the order processing time, product manufacturing time, and the delivery time indicated by the carrier.
Any reasonable delay in the delivery of the Product(s) shall not give rise to damages for the Buyer or to the cancellation of the order.
Delivery destination:
Deliveries are made to the address indicated by the Buyer for this purpose. Please note that if the Buyer does not claim their package from Mondial Relay or La Poste within the legal period of 7 days, the costs of returning their package will be entirely at their expense.
The delivery address must under no circumstances be a post office box or a hotel. The information provided by the Buyer when placing the order is binding. In the event of an error in the recipient's contact details, the Seller shall not be held responsible for the impossibility of delivering the Product(s).
An email is sent to the Buyer when the package is taken over by the carrier.
Delivery delay / Damaged products:
The Buyer is required to check the condition of the packaging and the Product(s) upon delivery. They may make any reservations and claims they deem necessary, or even refuse the package, if it is damaged upon delivery.
The Buyer must send reservations and claims to the carrier by registered letter with acknowledgment of receipt within three working days following the date of delivery of the Product(s). They must also send a copy of this letter to the Seller. Failure to make a claim within the aforementioned period extinguishes any action against the carrier in accordance with Article L. 133-3 of the Commercial Code.
Upon receipt of the order, the Buyer must check the conformity of the delivered Product(s). In the event of non-conformity of the Product(s), the Buyer must inform the Seller by email at contact@georgetta.fr or by mail to the following address: 5 rue des Louaches - 08600 Fromelennes - France, within 7 days, indicating the anomalies found on the received Product(s). Return costs are the responsibility of the Buyer. The Seller may ask the Buyer for photos of the defective Product(s).
In the event of proven non-conformity, the Seller will replace or refund the Product(s) and its delivery costs.
The Products are handed over to the carrier in perfect condition. No other express or tacit guarantee is granted.
In accordance with legal provisions, in the event of late delivery, you have the option of canceling the order under the conditions and terms defined in Article L 138-2 of the Consumer Code. If you receive the product in the meantime, we will proceed with its reimbursement and shipping costs under the conditions of Article L 138-3 of the Consumer Code.
In the case of home delivery, the Seller cannot be held responsible for delivery delays exclusively due to the unavailability of the customer after several appointment proposals.
ARTICLE 8 – DATA PROTECTION
Personal data is collected and mandatory for distance selling. It is necessary to process and deliver orders and to establish invoices. This data is used only for the company's activity. It is never shared with third parties or resold (French "Informatique et Libertés" law N° 78-17). Failure to provide this information implies automatic rejection of the order.
In accordance with the French "Informatique et Libertés" Law N° 78-017 of January 6, 1978, the User has the right to access, rectify, consult, and object to personal data concerning them. To exercise this right, the User must submit a request to the Seller by e-mail at contact@georgetta.fr or by mail to the following address: 5 rue des Louaches – 08600 Fromelennes – France.
ARTICLE 9 – FORCE MAJEURE
The Seller's liability cannot be invoked if the non-execution or delay in the execution of one of its obligations described in these general terms and conditions of sale results from a case of force majeure. In this respect, force majeure is understood as any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.
ARTICLE 10 – INTELLECTUAL PROPERTY
All elements of the Site (products, photos, texts) are the intellectual and artistic property of the Seller worldwide. Any total or partial reproduction is strictly prohibited and may be sanctioned (Articles L.335-2 et seq. of the Intellectual Property Code).
The name Georgetta is a registered trademark with the INPI (trademark no. 4463522). Any reproduction of this trademark, not authorized by the Seller, constitutes an act of infringement liable to criminal and civil prosecution.

ARTICLE 12 – APPLICABLE LAW – COMPETENT JURISDICTIONS
Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law.
Failing an amicable resolution, the dispute will be brought before the Commercial Court of Charleville Mézières (9 Esplanade Du Palais De Justice, 08000 Charleville Mézières)
ARTICLE 13 – ENTIRE AGREEMENT
These General Terms and Conditions of Sale and the order summary transmitted to the Buyer form a contractual whole and constitute the entirety of the contractual relations between the Parties.
In case of contradiction between these documents, the General Terms and Conditions of Sale shall prevail.
